When Joint Implants Fail: A Look into Exactech Litigation
Exactech, being a renowned manufacturer of medical devices
based in Florida, has been at the center of a growing wave of litigation tied
to its hip and knee replacement systems. Between 2021 and 2022, the company
issued broad recalls of Knee, ankle, hip, and shoulder implants due to faulty
packaging that lacked an oxygen barrier, resulting in premature oxidation and
failure of the polyethylene components.
The Defective Devices
Furthermore, the Exactech litigation involves several Exactech implant systems, including hip devices such as the Connexion GXL liner used in Novation, AcuMatch, and MCS systems. This led to the Exactech hip lawsuit recall in mid-2021, followed by a major hip device recall in 2022, and the AccuMatch hip system recall in early 2024.
Further, the knee replacements, which consist of Optetrak, Optetrak logic, and Truliant, were recalled even in February 2022 for a similar packaging defect.
It is the packaging flaw that exposed the devices to
oxidation, leading to cracking, device failure, pain, bone loss, swelling, and
the need for revision surgery.
Beginning of the Legal Battles
Early Exactech hip lawsuits surfaced in 2022. This includes that of Pope McGlamry's federal suit over the hip liner's alleged design and manufacturing defects and misleading marketing activities.
As a result, according to a broader legal practitioner from
People For Law, a wider wave of exactech litigation followed.
Around mid-2024, more than 1,600
cases were pending in an MDL (multidistrict litigation) before the U.S.
District Court for the Eastern District of New York, presided over by Judge
Nicholas G. Garaufis.
Bellwether Trials and MDL Progress
Another Exactech knee lawsuit emerged as part of the
Bellwether trials. It is a way to gauge outcomes, and the shape of the
settlement talks remains the key. Around late 2024, the first two bellwether
trials got scheduled. It includes those of.
- Tarloff
v. Exactech: July 6,
2025
- Larson v. Exactech: September 29, 2025.
However, additional Bellwether cases were selected,
including those of Kramer and Caputo, with later trial dates scheduled for 2026.
Bankruptcy Throws a Wrench in Litigation
Around October 2024, Exactech filed for Chapter 11 bankruptcy in the Delaware region. It triggered an automatic stay that paused most of the litigation and halted new exactech hip lawsuit filings in the MDL. This further delayed litigation and redirected several plaintiffs to file various claims, even during the bankruptcy process.
Therefore, by early 2025, the MDL had approximately 1,840 to 1,842 active cases, although no new filings were permitted due to this stay.
Since then, revised bankruptcy plans have emerged. According
to expert attorneys from People For Law, Exactech is now considering a
reorganization strategy that may not shield its private equity backer, TPG
Capital, from liability. Furthermore, ownership may transfer to lenders
(Strategic Value Partners and Stellex Capital Management), and a trust may be
established to pursue claims on behalf of approximately 2,600
unsecured creditors. Many of whom are injury plaintiffs.
Global Ripples
Unfortunately, the litigation stretched beyond Florida, USA. Even in Australia, approximately 4,500 patients are involved in a class action over faulty knee and hip implants, with mediation scheduled for early 2025. If no resolution is reached, plaintiffs risk being classified as unsecured creditors, even in the US bankruptcy system. Therefore, plaintiffs risk being classified as unsecured creditors in the US bankruptcy, which could jeopardize their overall financial recovery.
Final Thought
Moving forward, the interplay between MDL progress, scheduled bellwether trials, and the unfolding bankruptcy reorganization will continue to shape the future of the Exactech knee lawsuit. Therefore, much remains on the table, including compensation for victims, accountability for corporate decisions, and precedent for future Exactech litigation.
